Renting out a second home in Aix-en-Provence is no longer just a matter of posting a listing. Since 2026, two separate administrative procedures determine whether a rental is lawful: change of use authorisation from the town hall, and a national registration number obtained through the Declaloc platform. Many owners are aware of only one — and unknowingly expose themselves to a fine.

Change of use: a distinct authorisation, specific to Aix-en-Provence

Unlike a primary residence rented out for a few weeks a year, a second home used for short-term holiday rentals legally changes purpose: it shifts from residential to commercial use. In Aix-en-Provence, this change of use must be authorised in advance by the town hall, via a dedicated form sent to the relevant department (changementdusage@mairie-aixenprovence.fr).

Good news for owners in the Pays d'Aix: unlike Marseille or Paris, the City of Aix-en-Provence does not require compensation (the obligation to convert a commercial unit into housing to "offset" the loss of a residential unit). The procedure remains compulsory nonetheless, and failing to obtain authorisation can result in a fine of up to €10,000.

The Declaloc registration number, now required by booking platforms

Under the law of 19 November 2024 (the "loi Le Meur"), registering any short-term holiday rental became mandatory nationwide, with a deadline set at 20 May 2026. Aix-en-Provence is among the municipalities that had already made this declaration compulsory, via the local platform declaloc.myprovence.pro.

The process is free, available online around the clock, and issues a 13-character registration number immediately upon declaration. This number must appear on every listing published on Airbnb, Abritel, or any other booking platform: these platforms are now legally required to request it before publishing an offer. Renting out a property without a registration number exposes the owner to a fine of up to €5,000 per property.

Two procedures, one moment to sort them out

Change of use and Declaloc registration follow different logics — one is a planning matter, the other concerns taxation and rental traceability — but both are essential once a second home is rented out to holidaymakers in Aix-en-Provence. The end of summer is the right moment to check your situation ahead of next season: an incomplete change-of-use file or a forgotten Declaloc declaration is far easier to resolve outside the rental period.
